Registration or application for approval of food business operators, incl. importers of food from EU or third countries, or registration of producers, business to business distributors, intra-community traders or importers of food contact materials (FCM)

If you want to start a food business, incl. import food from other EU Member States or third countries, or have activities relating to food contact materials (FCM) in Denmark, your company must be registered or approved by the Danish Veterinary and Food Administration (DVFA).

 

The requirement of approval apply to all food businesses covered by Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin and for businesses producing sprouts covered by Commission Regulation (EU) No 210/2013 of 11 March 2013 on the approval of establishments producing sprouts pursuant to Regulation (EC) No 852/2004 of the European Parliament and of the Council.

 

For activities related to food contact materials, you are exempted from registration requirement, if your FCM activities on a yearly basis do not exceed 1 000 units and a turnover of 50 000 DKK.

To register or apply for approval you must fill in a special form and send it to the Danish Veterinary and Food Administration.

If your activities only require registration, you can start your food business after confirmation from the DVFA that your business is registered.

 

If your activities require approval, the DVFA will perform an on-site visit before an approval may be granted.

Registration or approval of other activities

The form must also be used to notify the DVFA if:

  • You want to take over an existing, active business (shift in ownership)
  • You have significant changes in your activities
  • You want to close down your business
  • You wish to trade food from other Member States into Denmark or import from third countries
  • Your establishment is the first place of destination for food of animal origin from other Member States, whether or not you are the importer.

Temporary or occasional pursuit

You must register as an importer if you bring in or receive food for sale in a movable or temporary food business establishment (e.g. food stands at festivals or summer resorts etc.)

If you are registered or approved as a food business operator in another EU Member State, you do not need a Danish registration/approval as a food business operator to run your temporary or movable food business, but you do need to register as an importer to bring in or receive food for sale in such establishments. You must provide the Danish Veterinary and Food Administration with the contact details of the authority, which has registered/approved your business (box 3) and with the company details under which your business is registered/approved (box 4).

Establishing a business

The same requirements apply for both temporary and permanent service providers.

Requirements for non EU citizens and businesses

The same requirements apply as for EU citizens and businesses.

Fee

No fee required.

When can I expect an answer?

The decision on whether or not to issue an approval will be made as soon as possible after all necessary documents have been received. Normally you can expect to get an answer from The Danish Veterinary and Food Administration within four weeks.

If your activities only require registration, you can start your food business after confirmation from the DVFA that your business is registered.

In case of rejection

If the Danish Veterinary and Food Administration decides to reject your application for approval or registration you will receive a reasoned notification. If you disagree with the decision to refuse your application, you have the right to appeal. The deadline for submitting an appeal is four weeks from date on which the decision was announced.

The appeal should be submitted in writing by e-mail, letter or fax to the Danish Veterinary and Food Administration who will forward your complaint to the Danish Environment and Food Board of Appeal. Find contact details to the Danish Veterinary and Food Administration below.
